Terms of Service

These terms ("Terms") govern your use of the AgView360 mobile application and any associated web platform (together, the "App"), operated by AgView360 Innovations Studio Private Limited ("we", "us", "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

AgView360 gives farmers crop and irrigation advice, AI-assisted disease and pest diagnosis, mandi (market) prices, a produce marketplace, and alerts. Buyers use the App to browse produce listings, see mandi prices, and contact the farmer who posted a listing; buyers do not receive farm advisories. You choose whether you are a farmer or a buyer when you register, and each has its own paid subscription — see clause 4. We may add, change, or remove features at our discretion, and will use reasonable efforts to notify you of material changes.

2. Eligibility & account

You must be at least 18 years old and provide accurate registration details. You are responsible for keeping your password and account-recovery answer confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access to your account.

3. Advisory disclaimer — please read

The advisories, diagnoses, price data and other information in the App are provided for general informational purposes only and are generated in part by automated models using the data available to us. They are not a substitute for professional agronomic, veterinary, financial or legal advice.

• AI diagnoses and recommendations can be wrong or incomplete. Always confirm with a qualified local agricultural expert before acting, especially before applying any input, chemical, or making a purchase or sale decision.
• Mandi prices are sourced from third-party/government feeds and may be delayed, incomplete, or inaccurate.
• Weather and soil figures are estimates from external data sources.
• We do not guarantee any yield, income, crop, or trading outcome, and are not liable for decisions you make based on the App.

4. Subscriptions & billing

There are two paid plans. Which one applies to you depends on whether you registered as a farmer or as a buyer.

• Farmers — Premium. New farmer accounts get a 30-day free period. During it, Climate Forecasting (weather) is available at no charge; the App's other services require Premium. After the 30 days, a Premium subscription is required to continue using the App. Premium is an auto-renewing subscription of ₹499 every 4 months.
• Buyers. Buyer accounts get no free period. A subscription is required before any buyer feature can be used, including browsing listings. The buyer plan is an auto-renewing subscription of ₹499 every 3 months.
• Payment is processed by Google Play. Your subscription is governed by Google Play's terms in addition to these Terms; the price you pay is the one shown on the Google Play purchase screen for your region.
• Subscriptions renew automatically until cancelled. Manage or cancel anytime in the Google Play app (Payments & subscriptions → Subscriptions), or via the link in the App. See our Cancellation & Refunds page for details.

5. Marketplace listings

Produce listings are transactions between farmers and buyers directly. We are not a party to, and are not responsible for, any transaction, quality claim, payment, or dispute arising from a listing. Do not post unlawful, misleading, fraudulent, or offensive content. We may remove any listing that violates these Terms.

6. Acceptable use

You agree not to misuse the App, attempt to breach or probe its security, scrape or reverse-engineer it, upload malware or harmful code, impersonate any person, or use it to harm others, violate any applicable law, or infringe any third party's rights.

7. Intellectual property

The App, its content, trademarks, and underlying models are owned by AgView360 Innovations Studio Private Limited or its licensors, and are protected under applicable intellectual property laws. You retain ownership of the content you submit (such as photos and listings) and grant us a worldwide, royalty-free licence to host, process, and use that content solely to operate, provide, and improve the App's services.

8. Limitation of liability

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, and we are not liable for indirect, incidental, or consequential losses, or for any loss arising from reliance on the App's information (see clause 3). Where our liability cannot be excluded under applicable law, it is limited to the total subscription fees you paid to us through Google Play in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be lawfully limited or excluded, including under India's consumer-protection laws.

9. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or demand arising from your breach of these Terms, your misuse of the App, or content you submit, to the extent permitted by applicable law.

10. Termination

We may suspend or terminate accounts that breach these Terms, with notice where reasonably practicable. You may stop using the App and delete your account at any time. Clauses that by their nature should survive termination (including clauses 3, 7, 8, 9, 10, and 11) will continue to apply.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be notified within the App. Continued use of the App after such notice means you accept the revised Terms.

12. Governing law & dispute resolution

These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts of Hyderabad, Telangana, India have exclusive jurisdiction over any dispute arising from these Terms or your use of the App.
